§1 GENERAL PROVISIONS

  2. Niniejszy regulamin jest skierowany zarówno do konsumentów jak i do przedsiębiorców korzystających ze sklepu internetowegowww.arkor.pli określa zasady korzystania ze sklepu internetowego oraz zasady zawierania umów sprzedaży na odległość za pośrednictwem sklepu.

§2 DEFINITIONS

  1. Consumer – a natural person concluding a contract with the store within the store, the subject of which is not directly related to his or her business or professional activity.
  2. Entrepreneur – a natural person, a legal person or an organizational unit that is not a legal person, which is granted legal capacity by law, conducting business activity on its own behalf, and using the store.

§4 CONCLUSION OF THE AGREEMENT

  1. W celu zawarcia umowy sprzedaży za pośrednictwem sklepu należy wejść na stronęwww.arkor.pl, dokonać wyboru towarów poprzez ich dodanie do koszyka, a następnie, po zapoznaniu się z regulaminem sklepu i akceptacji jego treści oraz po podaniu danych niezbędnych do realizacji umowy, kliknąć przycisk „Zamawiam i płacę”.
  2. The sales contract is concluded when the store confirms the order and sends an appropriate notification to the customer.

§5 PAYMENTS

  1. Possible payment methods include: payment on delivery, bank transfer, electronic payment via payment systems available on the store's website.
  2. If you choose a bank transfer, the customer should make the payment to the account number: ING Bank: account number. The transfer title should include: order number, name and surname of the person placing the order.

§6 SHIPPING

  1. Products are shipped within Poland and to selected countries listed on the store's website.
  2. The goods are delivered via a postal or courier operator. Delivery costs are always provided during the ordering process.
  3. The order processing time is up to 5 business days and is counted from the date of order confirmation in the case of payment on delivery or from the date of crediting the payment to the Store's account in the case of payment by transfer.

§7 RIGHT TO WITHDRAW FROM THE CONTRACT

  1. A consumer who has concluded a distance contract may withdraw from it within 14 calendar days without giving a reason and without incurring costs, except for the costs specified in point. 5 and 6 below.
  2. The deadline for withdrawal from the contract starts from the date of receipt of the goods by the Consumer.
  3. The declaration of withdrawal from the contract should be sent to the store's e-mail address: arcor.market@gmail.com

§8 COMPLAINTS AND WARRANTIES

  1. The Store, as a seller, is liable to the Customer who is a Consumer under the warranty for defects to the extent specified in the Civil Code, in particular in Art. 556 et seq. of the Civil Code.
  2. Reklamacje można zgłaszać pisemnie na adres: Arkor Plant Health Oleksandr Maksymenko, Szczecińska 17/59 25-345 Kielce, Polska, lub drogą elektroniczną na adres e-mail:arcor.market@gmail.com.The complaint should include the following data: the Customer's name and surname, the Customer's e-mail address, date of purchase of the goods, type of goods, receipt/invoice number, detailed description of the defect and the Customer's request.
  3. The store undertakes to consider each complaint within 14 days from the date of its receipt. If it is necessary to return the goods to the Store, the shipping costs are covered by the Customer.
  4. The customer will be informed about the result of the complaint procedure electronically or in writing.
  5. If the complaint is upheld, the Store undertakes to repair or replace the goods with new, full-value ones, and if this is impossible (for example due to lack of goods), the Store will refund the buyer the equivalent of the product price or offer him other goods available in the store to choose from. .
  6. The store is not liable for damage resulting from improper use of products.

§9 PERSONAL DATA

  1. The administrator of the personal data of the Store's Customers is the seller.
  2. Customers' personal data are processed solely for the purpose of fulfilling orders.
  3. Detailed information on the processing of personal data can be found in the store's Privacy Policy.

§10 DISPUTES RESOLUTION

  1. Disputes arising from the implementation of the concluded contract will be resolved first through negotiations, with the intention of ending the dispute amicably.
  2. If an amicable settlement of the dispute is not possible, the dispute will be resolved by a court having jurisdiction in accordance with the provisions of the Code of Civil Procedure.
  3. The consumer has the opportunity to use out-of-court methods of dealing with complaints and pursuing claims. Among other things, the Consumer has the opportunity to: (1) apply to the permanent consumer arbitration court operating at the Trade Inspection, (2) apply to the provincial inspector of the Trade Inspection, (3) use the assistance of the district (municipal) consumer ombudsman.

§11 CHANGES TO THE REGULATIONS

  1. The store reserves the right to make changes to these regulations.
  2. All orders accepted by the Store before the date of entry into force of the new version of the Regulations are processed on the basis of the Regulations that were in force on the day the order was placed by the Customer.
  3. The Customer will be notified of any changes to the Regulations electronically (to the e-mail address provided during registration or placing an order). The notification will be sent at least 14 days before the amended Regulations enter into force.
  4. If the Customer does not accept the content of the new Regulations, he has the right to terminate the contract at any time.

§12 FINAL PROVISIONS

  1. Wszystkie prawa do sklepu, w tym prawa autorskie, prawa własności intelektualnej, w tym znaków towarowych i patentów, należą doArkor Plant Health Oleksandr Maksymenko.
  2. Każde wykorzystanie przez kogokolwiek, bez wyraźnej pisemnej zgodyArkor Plant Health Oleksandr Maksymenko, jakiejkolwiek części sklepu, w szczególności poprzez kopiowanie, modyfikację, dystrybucję, transmisję, ponowne publikowanie, usuwanie, dodawanie, sprzedaż, dystrybucję elementów sklepu, jest surowo zabronione.
  3. The Regulations enter into force on November 19, 2023.
